Welcome to Nomad Dirt Culture. These Terms & Conditions govern your use of our website, the purchase of merchandise, video content licensing and participation in our membership frameworks. By accessing our website, purchasing products, utilising our media assets or registering for a subscription membership, you agree to be bound by these Terms & Conditions.
Nomad Dirt Culture provides independent journalism, news media reporting and historical archival services connected with motorsport culture. This platform is owned and operated by Nomad Dirt Culture Pty Ltd under an exclusive master intellectual property license from Nomad Dirt Culture IP Pty Ltd.

Inventory Adjustments: We reserve the right to modify, restock, or permanently discontinue any product line or event merchandise at our absolute discretion without notice. Limited edition event merchandise will generally not be restocked once a release run is exhausted.

Pricing, Payments & Financial Processing

Currency: All pricing tiers are explicitly listed in AUD (Australian Dollars) and are calculated exclusive of GST unless stated otherwise.

Price Adjustments: Retail prices and subscription parameters may be updated without notice.

Transaction Authorisation: Payment must be cleared in full through our secure payment processing gateways before an order is fulfilled or dispatch parameters are initiated.

Electronic Confirmation: Receipt of an automated email confirmation does not constitute a legally binding contract of sale. An order constitutes an offer to purchase, which is accepted only upon the physical dispatch of the items.

Commercial Restrictions: We reserve the right to limit product quantities per customer, per household, or per account, and may cancel orders that appear to be placed by unauthorized automated scripts, commercial distributors, or resellers.

Shipping, Title and Operational Risk

Risk of loss, damage or destruction of physical assets passes cleanly to the purchasing party upon handover of the parcel to the designated freight carrier (e.g., Australia Post).

Any transfer duties, customs assessments, or regional import taxes applied to international shipments are the sole financial responsibility of the purchasing client.

Going Concern Allocation: All transactions and asset movements associated with the restructure of Nomad Dirt Culture are supplied as a tax-free "Supply of a Going Concern" under A New Tax System (Goods and Services Tax) Act 1999 (Cth).

Taxable Supplies: All general commercial listings, ledger access options, and standard product sales are subject to GST calculation where applicable by Australian statutory law.

Insurance & Public Liability

The operating entity maintains comprehensive public liability insurance to indemnify its commercial operations against liability for acts or omissions occurring during coverage terms.

The Licensee (Nomad Dirt Culture Pty Ltd) assumes sole operational liability for consumer product fulfillment, event organization safety compliance, and general business execution risks.

Intellectual Property & Asset Vault Protection

Ownership: The user acknowledges that Nomad Dirt Culture IP Pty Ltd retains absolute right, title and ownership over all intellectual property assets, including but not limited to the primary domain url (nomaddirtculture.com), official secure email configurations, the unified social media network array (Instagram, Facebook, TikTok, YouTube, LinkedIn handles), trade names, logos, written copyright journalism, and the 125-year motorsport content archive.

Intellectual Property Improvements: Any modifications, brand adaptations or media content developments created by or on behalf of the operating entity during its commercial lifecycle are instantly and completely assigned to Nomad Dirt Culture IP Pty Ltd.

Title Protection: No user or third party may use, reproduce, modify, mimic or register any common-law trademark, unregistered brand marker, layout system, or asset belonging to Nomad Dirt Culture IP Pty Ltd without express, written corporate authorization from the director.

Confidentiality Boundaries

All technical guidelines, trade secrets, partner list data, pricing algorithms, proprietary backend code configurations, and operational workflows disclosed across our digital rooms or ledger pipelines are strictly confidential.

Users, contractors, and network partners are legally prohibited from distributing or disseminating any non-public data, source documents, or system infrastructure information without explicit prior authorization in writing.

Indemnity Shield

To the full extent permitted by law, you agree to fully indemnify, defend, and hold harmless Nomad Dirt Culture Pty Ltd, Nomad Dirt Culture IP Pty Ltd, and their directors, officers, employees, and associates from and against any and all claims, damages, financial losses, liabilities, legal costs, or structural court expenses arising from your misuse of the platform, violation of these terms, or infringement on third-party intellectual property rights.

Termination and Data Exclusion

Breach Protocols: Nomad Dirt Culture reserves the absolute right to suspend, terminate, or delete any comment user profile, Paddock Account, or commercial ledger seat immediately and without prior notice if a user breaches our community terms, attempts code injection, or engages in malicious actions.

Action on Termination: Upon account termination, all user privileges, digital vault access pathways, and comment publishing licenses cease immediately.

Journalistic Independence & Non-Affiliation

Absolute Autonomy: Nomad Dirt Culture operates strictly as an independent, standalone commercial media network, digital publisher and grassroots motorsport archivist.

No Third-Party Representation: We do not represent, partner with, act as a legal agent for, or maintain corporate affiliation with any private motorsport clubs, regional promotional committees, track owners or localised political development factions.

Separation of Liability: The views, corporate compliance failures, regulatory mandates, operational liabilities, safety omissions or structural legal disputes of external sporting clubs or venue operators are entirely separate from us. We assume zero legal or financial liability for the actions, statements, choices, or failures of third-party sporting organizations.

Fair Dealing & Archival Architecture

Fair Dealing Compliance: To the extent that this platform displays media components, screenshots of public social media campaigns, community advocacy prints, or historical document excerpts, such elements are utilized strictly under Fair Dealing provisions of the Copyright Act 1968 (Cth) for the explicit purposes of reporting the news, educational commentary, and historical archival preservation.

Curated Assets: All custom-engineered media analysis graphics, verified data registries, maps, and curated portal environments displaying official branding or trademark seals remain the exclusive intellectual property of the asset protection holding entity.

Professionalism & The "Paddock Boards" Standards The integrity of grassroots motorsport is rooted in mutual respect, raw authenticity, and high professional standards. We enforce an absolute zero-tolerance policy regarding toxic digital behavior across our website, comment frameworks, portal engines, and connected social lines.

Prohibited Conduct: Users are strictly prohibited from publishing or transmitting content that constitutes personal defamation, targeted harassment, malicious disinformation campaigns, profanity, racial slurs, or abusive threats against any member of the sporting community, track operators, racers, or platform administrators.

Enforcement Protocol: We retain the unilateral right, at our sole discretion, to instantly delete offending text, freeze comment profiles, and permanently revoke premium memberships or Heritage Vault access tokens without warning or liability for financial refund.

The "Track Guardian" Membership Transition

Strategic Assignment: All active user accounts, subscriptions, and Track Guardian or Heritage Vault memberships created prior to 1 July 2026 are officially assigned from Jocelyn Dare (sole trader) to Nomad Dirt Culture Pty Ltd. Your recurring billing cycles, data protection profiles, and access accounts continue seamlessly under the secure oversight of the operating entity.

Cancellation Metrics: Subscriptions run on a rolling monthly cycle. You can cancel your profile access tier at any time through your account portal. Upon cancellation processing, your premium access features remain active until the exact final day of the current paid billing cycle, after which access parameters revert to the default free configuration.

Video Content Production, Master Licensing and Deliverables

Service Definitions: Delivery of lightly processed, color-corrected source video files or premium custom production reels incorporates proprietary styling and official trademark branding under strict license.

Retention of Ownership: All source footage, edited master files, audio integration tracks, and digital components captured or produced by platform operators remain the absolute property of Nomad Dirt Culture IP Pty Ltd.

Standard Personal-Use License: Every standard media purchase includes a non-transferable, revocable Personal-Use Media License, strictly prohibiting public broadcasting, corporate sponsorship integration, or distribution to third-party commercial networks.

Commercial Exploitation: Any utilization of video content for corporate promotion, sponsored media, or monetized digital broadcasts requires a signed Commercial Use Contract and up-front commercial licensing fees. Unauthorised usage results in retroactive invoicing at our corporate licensing premium and immediate suspension of platform privileges.

Custom Commissions & Non-Refundability: Bespoke production services require an independent, fully executed Custom Production Contract. Digital deliverables and custom production assets are non-refundable once compilation work begins.

Limitation of Liability for Asset Exploitation

The Licensee (Nomad Dirt Culture Pty Ltd) will be solely responsible for all loss or damage arising out of the operation of the business or arising out of the acts or omissions of the Licensee or any of its agents, servants or contractors in connection with the use of the Licensed Assets. The Licensor accepts no liability for claims for damage to property or for injury or death of any persons directly or indirectly resulting from operational exposure.

Law and Jurisdiction

This Agreement is governed strictly by the laws in force in the State of Queensland, Australia. All parties submit to the non-exclusive jurisdiction of the courts of Queensland in respect of any proceedings arising in connection with this agreement.
