Welcome to Nomad Dirt Culture (“NDC”, “we”, “our”, “us”). These Terms & Conditions govern your use of our website, purchase of merchandise, and participation in our Track Guardian membership. By accessing our website, purchasing products, or signing up for membership, you agree to comply with and be bound by these Terms & Conditions. Nomad Dirt Culture (NDC) provides independent reporting and clinical auditing of motorsport assets. In our capacity as a media entity, we document the loss of social license through forensic reporting and the fair dealing of industry news for the purpose of public education and heritage preservation.

  • We reserve the right to modify or discontinue products without notice.

  • Limited edition or event merchandise may not be restocked.

4. Pricing & Payments

  • All prices are listed in AUD (Australian Dollars).

  • Prices may change without notice.

  • Payment must be received in full before an order is processed.

  • We reserve the right to cancel orders due to pricing errors, suspected fraud, or stock unavailability.

5. Order Acceptance & Cancellation

  • Once an order is placed, you will receive confirmation via email.

  • NDC may refuse or cancel orders at our discretion.

  • We may limit quantities per customer or cancel orders suspected of resale or misuse.

  • Refunds will be issued to the original payment method if an order is cancelled.

6. Shipping & Delivery

  • Processing times vary depending on stock and release type (standard or pre-order).

  • Estimated delivery times will be outlined at checkout.

  • NDC is not responsible for:

    • Postal carrier delays

    • Incorrect addresses provided by customers

    • Customs delays (if applicable)

  • Risk of loss passes to the customer upon dispatch.

7. Returns & Refunds

  • Under Australian Consumer Law, customers are entitled to replacement or refund for major faults.

  • We do not offer refunds for:

    • Change of mind

    • Incorrect sizing chosen by the customer

    • Minor variations in print or colour

  • Customers must contact us within 7 days of receiving a faulty item, with photo evidence.

  • Approved refunds will be processed to the original payment method.

8. Intellectual Property

  • All content on this website—including logos, designs, branding, text, images, and media—is the property of Nomad Dirt Culture.

  • You may not reproduce, distribute, modify, or use our content for commercial purposes without written permission.

9. Media & Brand Protection

  • NDC is a motorsport media platform. Purchase of merchandise does not grant rights to use NDC branding for promotional or commercial purposes without written approval.

  • NDC operates as an independent commercial entity. Any attempt by third parties to interfere with NDC’s commercial trade or accredited media operations may result in legal action for Tortious Interference and Restraint of Trade.

  • Media captured at public motorsport events is the property of NDC. If you would like content featuring you or your child removed, please contact us.

10. Video Content & Reel Services

Enhanced RAW Clips: lightly processed video files for personal use or further editing.
Custom Edited Reels: premium edits with music, slow motion, and branding.

  • All content remains the intellectual property of NDC.

  • Personal-use license granted upon purchase; commercial use requires written permission.

  • Digital products are final sale; refunds not available after delivery.

  • Custom reel requests require prior agreement on pricing, turnaround, and creative direction.

11. Track Guardian Membership

As a Track Guardian member, you agree to:

  • Membership is $10/month (AUD), recurring via Shopify App.

  • Benefits include:

    • Exclusive behind-the-scenes content (reels, stories, documentaries)

    • Membership-only merchandise drops (stickers, apparel, and items unavailable to the public)

    • 10% off all NDC Reel Creation Services

    • Recognition as part of the NDC community

  • Membership is non-transferable and for personal use only.

  • Merchandise availability is subject to stock; we cannot guarantee timing or quantities.

  • You may cancel anytime; benefits remain until the end of the current billing period.

By joining, you directly support NDC’s mission to preserve grassroots motorsport, document real stories, and give riders and communities recognition.

12. Limitation of Liability

To the maximum extent permitted by law, NDC is not liable for:

  • Indirect or consequential loss

  • Loss of profits or business opportunities

  • Delays outside our reasonable control

Liability is limited to the purchase value of the product.

13. Privacy

  • Personal information is collected for order processing, shipping, and membership management.

  • We do not sell or share personal information, except as required for payment processing and shipping.

14. Governing Law

  • These Terms & Conditions are governed by the laws of Australia.

  • Any disputes will be resolved under Australian jurisdiction.

NOTE: Nomad Dirt Culture, operated by Jocelyn Dare, strives for accuracy in product descriptions, pricing, and content. However, minor errors, stock differences, or pricing issues may occur. NDC reserves the right to cancel orders or correct errors as necessary.
